KULLANICI SÖZLEŞMESİ Madde 1 Taraflar ve Konu: Bu sözleşme, , www.healthmaster.ist internet sitesinden, google playstore ve appstore vb. hizmet sunan platformlardan elektronik ortamda veya çeşitli firmalar aracılığıyla Diet Menum uygulamasını satın alan yada hediye edilen kişi (bundan böyle ALICI olarak anılacaktır) ile ADRESİMİZ VE TİCARİ ADIMIZ (bundan böyle HEALTH MASTER GLOBAL ŞİRKETİ olarak anılacaktır.) arasındaki alışverişe ilişkin olarak Tüketicinin Korunması Hakkındaki Kanun ve Mesafeli Sözleşmeler Uygulama Esas ve Usulleri Hakkındaki Yönetmelik hükümleri kapsamında yapılan ürün satışı, teslimi ve koşulları ile tarafların hak ve yükümlülükleri saptanmaktadır. Alıcı, HEALTH MASTER GLOBAL Şirketi'nin isim, unvan, açık adres, telefon ve varsa diğer erişim bilgileri, internet sitesinde yayınlanan uygulamaların temel nitelikleri, tüm vergiler dahil satış fiyatı, ödeme şekli ve teslimat koşulları, sözleşmenin süresi ile ilgili tüm ön bilgiler konusunda açık, anlaşılır ve internet ortamına uygun şekilde satıcı tarafından bilgilendirildiğini, bu ön bilgileri elektronik ortamda teyit ettiğini sipariş verdiğini kabul ve beyan eder. http://www.healthmaster.ist internet sitesinde, google playstore ve appstore vb. hizmet sunan platformlarda düzenlenen faturalar sözleşmenin ayrılmaz parçalarıdır. Article 1 Parties and Subject: This contract encompasses individual parties who bought or got donated (hereby referred as the BUYER) Diet Menum from www.healthmaster.ist website, Google PlayStore and AppStore etc. and such digital platforms or through various other companies and purchaser's relations concering the transaction with our ADDRESS AND TRADE (hereby referred as HEALTH MASTER GLOBAL Company) in terms of Law on the Protection of Consumers and Distant Contracts, Provisions of the Regulation on Implementation Principles and Procedures and the sale, delivery and conditions of the products made under said laws, determining the rights and responsibilities of involved parties on the subject. The buyer declares that they were informed about the Health Master Global Company's name, title, open address, phone number and if available, other contact information, application's basic qualities and functions, sales price including all tax, form of payment and terms of delivery and duration of contract clearly, understandably and suitably for the internet environment by the seller and acknowledges and declares that they confirmed this preliminary information in electronic environment. Bills issued on serving platforms such as http://www.healthmaster.ist website, Google PlayStore and AppStore etc. are integral parts of the contract. Madde 2 Sözleşme Tarihi ve Yürürlüğü: Alıcı www.healthmaster.ist internet sitesinden, google playstore ve appstore vb. hizmet sunan platformlardan veya çeşitli firmalar aracılığıyla elektronik ortamda siparişlerini gerçekleştirir. Sözleşme tarihi, Alıcı’nın sipariş verdiği tarihtir. Sözleşmenin yürürlüğe girmesi ve seçilen uygulamaların indirilmesi için alıcının ürün bedelini tam olarak ödemiş olması şarttır. Sözleşme http://www.healthmaster.ist internet sitesinden, google playstore ve appstore vb. hizmet sunan platformlardan elektronik ortamda veya çeşitli firmalar aracılığıyla sözleşme koşullarında teslimi ile kendiliğinden sona erer. Article 2 Contract Date and Management: Purchaser initiates the transaction on electronic platforms such as www.healthmaster.ist websites, Google PlayStore, AppStore etc. serving applications or through various companies. Contract date is the date purchaser made the order. In order for the contract to initiate and to download selected applications, the buyer must pay the full price of the product. Contract, terminates itself after contract delivery from www.healthmaster.ist website, Google PlayStore, AppStore etc. and such platforms or through various companies under the agreement terms. Madde 3 Bireysel günlük nutrient ihtiyaç kompozisyonlarının belirlenmesi, girilen veya elde edilen verilerin grafik ve/veya istatistiki takibi : Diet Menum uygulamasında Adım, Hız, Mesafe, Enerji harcaması hesaplanmakta, Hız ve Mesafe planlaması yapılmakta, belirlenen günlük egzersiz aktivitesinin aşılması halinde Bonus yiyecek ve içecek önerilmektedir. Bu parametrelerin hesaplanılmasında mobil cihazların hareket sensörlerine ait veriler kullanılmaktadır. Bu sensörlerden gelen verilere ait sorun veya hatalardan ve bunun alıcıya yansımasından HEALTH MASTER GLOBAL ŞİRKETİ sorumlu değildir. Diet Menum uygulamasında kişilerin yaşlarına, basit veya detaylı PAL (Fiziksel aktivite düzeyi) değerlerine, cinsiyetlerine, egzersizlerine, hedef kilo ve bu kiloya ulaşmaları için planladıkları hedef günlerine, ve/veya hastalıklarına göre günlük (Enerji, karbonhidrat, yağ, protein, vitaminler, aminoasitler, şekerler, yağ asitleri ... vb. yaklaşık 140 nutriente ait) ihtiyaçları hesaplanarak online alıcının kullanımına sunulmaktadır. Bireysel Nutrient Kompozisyonlarının alıcının kendi beyanı olan, yaşlarına, basit veya detaylı PAL (Fiziksel aktivite düzeyi) değerlerine, cinsiyetlerine, egzersizlerine, hedef kilo ve bu kiloya ulaşmaları için planladıkları hedef günlerine, ve/veya hastalıklarına göre oluşturulduğundan alıcının hatalı ve yanlış beyanı sonucunda belirlediği hedefe ulaşamamasından veya istatistiki/grafik anormalliklerden HEALTH MASTER GLOBAL ŞİRKETİ sorumlu değildir. Diet Menum uygulamasının ihtiyaç duyabileceği alıcının kişisel veya bir tıp profesyoneli yardımı ile elde edilen (Ağırlık, BMI, Bel Çevresi ve Kalça Çevresi Ölçümleri, ve/veya Vücut Toplam Yağ, Visseral Yağ, Kas ölçüm değerleri, Arteriyel Kan Basıncı, SaO2, Nabız ve Ateş değerleri, ve/veya Açlık Kan Şekeri, Tokluk Kan Şekeri (2.saat) ve HbA1c ... vb. laboratuvar değerleri,) uygulamalarda istatistiki olarak gösterilen parametreler kullanıcı veya izin verdiği tıp profesyoneli tarafından uygulamaya kaydedilerek oluşturulduğundan alıcının hatalı ve yanlış beyanı sonucunda belirlediği hedefe ulaşamamasından HEALTH MASTER GLOBAL ŞİRKETİ sorumlu değildir. Özel sağlık sorunlarının bulunması veya profesyonel desteğe ihtiyaç duyulan bir durumda Diyetisyen, Doktor, Psikolog/Psikiyatrist, Spor Eğitmeni, Fizyoterapist ... vb. uzmanlara danışması gerektiğini bildiğini beyan eder. Article 3: Determination of the daily nutrient need composition and the graphical or statistical follow up on values acquired or input manually: With the Diet Menum application, Steps, Speed, Distance and Calories burned are calculated, Speed/Distance ara planned, and Bonus drinks/food are recommended when the daily exercise limit is surpassed. The motion sensors of mobile devices are used to determine these parameters. The HEALTH MASTER GLOBAL Company is not responsible for any errors in data coming from these sensors and affecting the buyer. In the Diet Menum application, the persons age, basic or detailed PAL rates, gender, exercises, target weight and the day count to achieve this weigh, and/or their needs (calories, carbohydrates, fat, proteins, vitamins, aminoacids, sugar, fat acids etc... nearly 140 nutrients) are calculated and is displayed for the online user. HEALTH MASTER GLOBAL COMPANY is not responsible for the user not reaching their target or statistical/graphical anomalies caused by faulty values input by the user, such as age, basic and detailed PAL values, gender, exercises, target weight and time to achieve said weight and diseases. HEALTH MASTER GLOBAL COMPANY is not responsible for the user not achieving goals due to information that the Diet Menum application might need, that are input with fault by the user or a medicine professional (Weight, BMI, Waist and Hip size, and/or whole body fat, Visceral Fat, Muscle Values, Arterial Blood Pressure, Sa02, Pulse and Body Temperature, preprandial blood glucose, postprandial blood glucose, HbA1c and such values.) Madde 4 Ödeme Koşulları: Ürün bedeli, alıcı’nın seçtiği ve sözleşme tarihinde http://www.healthmaster.ist internet sitesinden, google playstore ve appstore vb. hizmet sunan platformlardan elektronik ortamda veya çeşitli firmalar aracılığıyla ilan edilen fiyattır. HEALTH MASTER GLOBAL şirketi ürün fiyatlarını her zaman değiştirme hakkına sahiptir. Alıcının sözleşmenin sona ermesinden sonra yeniden siparişte bulunması halinde güncel tarife geçerli olacaktır. Ödemeler kredi kartı ile yapılır. Article 4 Terms of Payment: The price of the product is what is declared either by http://www.healthmaster.ist, google playstore, appstore and the likes or via various companies on the date of the buyers purchase and agreement. HEALTH MASTER GLOBAL COMPANY has the right to alter the product prices anytime. The current fare will be valid if a new order is issued after the end of the users contract. Payment is made via credit card. Madde 5 Sözleşmenin Feshi: Alıcı, Diet Menum uygulamasını kullanmaktan imtina etmesi, sözleşmeden vazgeçmesi veya sözleşmeyi haklı nedeni olmaksızın tek yanlı olarak feshetmesi halinde HEALTH MASTER GLOBAL Şirketinden hiç bir talepte bulunmayacağını kullanmaktan vazgeçtiğini/imtina ettiği veya sözleşmeyi tek yanlı olarak feshettiği için uygulama bedellerinin kısmen dahi olsa iadesini istemeyeceğini kabul ve taahhüt etmektedir. Article 5 The cancellation of the agreement contract: In the case of the buyers refusal to use Diet Menum, giving up the contract, or voiding the agreement with no right cause, the buyer agrees that they will not request anything from the HEALTH MASTER GLOBAL Company, and agree that they will not request a full or partial refund because they refused to use the application or voided the agreement. Madde 6 Sözleşme Değişiklikleri: HEALTH MASTER GLOBAL Şirketi sözleşme şartlarında değişiklik yapma hakkına sahiptir. Bu gibi bir durumda, değişikliklerin tümü www.healthmaster.ist internet sitesinden, google playstore ve appstore vb. hizmet sunan platformlardan elektronik ortamda yayınlanacak ve değişikliklerden sonra yapılacak sipariş ve alımlar bakımından geçerli olacaktır. Article 6: Agreement Changes: HEALTH MASTER GLOBAL has the right to change or alter the agreement conditions. In such cases, all the changes will be published on the website www.healthmaster.ist, google playstore, appstore and the likes, and will be valid on purchases and orders issued after the changes. Madde 7 Gizlilik: HEALTH MASTER GLOBAL ŞİRKETİ bu sözleşme kapsamında Alıcı hakkında edindiği hiç bir bilgiyi hiç bir kişi ve kurumla paylaşmayacağını ve iş bu sözleşmeyle üstlendiği edimleri ifa kapsamının dışında kullanmayacağını taahhüt eder. Alıcı’nın ödeme yaparken işlemin yapıldığı bankaya ulaştırılmakta ve provizyon alınmakta kullanılan kredi kartı bilgileri hiçbir şekilde HEALTH MASTER GLOBAL ŞİRKETİ tarafından kaydedilmemektedir. Article 7: Privacy: Health Master Global pledges with this agreement that any information collected about the Buyer will not be shared with any person or institution, and that any actions acquired by this agreement will not be used outside the applications duty. Credit Card information is only used to deliver to the bank, or for provision payment, and is by no means recorded by the HEALTH MASTER GLOBAL Company. Madde 8 Delil Anlaşması ve Yetkili Mahkeme: Bu sözleşmeden ve uygulanmasından kaynaklanabilecek uyuşmazlıkların hallinde HEALTH MASTER GLOBAL’in bilgisayar kayıtları, ticari defter, belge ve kayıtları kesin delil oluşturur. İhtilafların çözümünde parasal sınırlar dâhilinde Tüketici Hakem Heyetleri, İstanbul Tüketici Mahkemeleri ve İcra Daireleri yetkilidir. Article 8 Evidence Agreement and Authorized Court: In the case of disputes regarding this contract, HEALTH MASTER GLOBAL Company's computer records, commercial ledgers, documents and records form absolute evidence. In the settlement of disputes, Consumer Arbitration Delegations, Istanbul Consumer Courts and Execution Offices are authorized within monetary limits.
